1. Agreement to Terms

By accessing or using the Genesis Electrical Services platform at app.genesis-electric.net (the "Platform"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Platform.

2. Program Description

Genesis Electrical Services provides a customer portal and team management platform for managing electrical service jobs, estimates, invoices, scheduling, and communications. The Platform includes SMS text messaging notifications for service-related updates.

3. SMS Text Messaging Terms

By providing your phone number and using our services, you consent to receive service-related SMS text messages from Genesis Electrical Services. The following terms apply to our SMS messaging program:

• Program Name: Genesis Electric Service Notifications
• Message Types: Customer portal access links, invoice notifications, estimate updates, job scheduling information, payment confirmations, and other service-related communications.
• Message Frequency: Message frequency varies based on your service activity. You may receive messages when invoices are created, estimates are ready, jobs are scheduled or updated, and when portal access links are sent.
• Message & Data Rates: Message and data rates may apply. Please contact your wireless carrier for details about your messaging plan.
• Opt-Out: You may opt out of receiving SMS messages at any time by replying STOP to any message from us. After opting out, you will receive a confirmation message and will no longer receive SMS notifications.
• Help: For assistance, reply HELP to any message or contact us at (941) 716-9298.
• Supported Carriers: Compatible with major US carriers including AT&T, T-Mobile, Verizon, Sprint, and others. Carrier support may vary.

4. Customer Portal

The customer portal provides access to view job details, estimates, invoices, and make payments. Portal access is granted via secure magic links sent to your phone number or email. You are responsible for maintaining the confidentiality of your portal access links and should not share them with unauthorized individuals.

5. Payments

Payments processed through the Platform are handled securely by Stripe, our third-party payment processor. By making a payment, you agree to Stripe's terms of service. Genesis Electrical Services does not store your full credit card information on our servers.

6. Estimates & Invoices

Estimates provided through the Platform are approximations and may change based on actual job conditions. Final pricing will be reflected in the invoice. Invoices are due upon receipt unless otherwise specified. Late payments may be subject to additional fees as outlined in your service agreement.

7. Intellectual Property

The Platform and its content, features, and functionality are owned by Genesis Electrical Services and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from any portion of the Platform without our written consent.

8. Limitation of Liability

Genesis Electrical Services shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability for any claim arising from or related to the Platform shall not exceed the amount you paid for services in the twelve months preceding the claim.

9. Disclaimer

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, secure, or error-free.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Kentucky, without regard to its conflict of law provisions.
